Whereas:

All the rights included in the contents submitted to China Media Group by me when participating in the “CGTN The Media Challengers” talent campaign, including but not limited to the texts, pictures, videos, audio, and personal portraits, music, sounds, dialogues, etc. included in the videos and/or audio (hereinafter collectively referred to as "Contents"), are legally held by me, and I am entitled to license or sublicense such rights and qualified to sign this Declaration and conduct businesses with the Contents.

I hereby declare as followed:
1. By submitting the Contents, I automatically grant China Media Group and its affiliates, controlling entities and successors (hereinafter collectively referred to as "Licensees") the worldwide, royalty-free, perpetual, irrevocable, non-exclusive right and license, but not the obligation, to use the Contents, including the right to reproduce, publish, modify, adapt, edit, translate, compile, disseminate/distribute, create derivative works, screen, broadcast, exhibit, and other commercial or non-commercial exploitation of the Contents, as well as the right to sub-license such right for the full term of any right that may exist in such Contents, without payment to me or to any third parties. To avoid ambiguity, the right granted to the Licensees shall allow the Licensees to produce TV programs with the Contents as materials, and broadcast the programs on the Licensees’ platforms, including but not limited to CGTN official website, APP, Facebook official account, YouTube official account, Twitter official account, Yangshipin, Sina Weibo official account, Bilibili official account, WeChat video official account, Tik-Tok official account, etc., as well as CGTN TV and any other platforms of the Licensees.
2. I hereby represent and warrant that I have the full legal right to the Contents, and the use of the Contents or the Licensees’ exercise of the right to the Contents granted herein shall not violate any applicable laws and regulations or infringe upon any rights. I further grant the Licensees the right, but not the obligation, to pursue at law any person or entity that infringes my or Licensees’ rights in the Contents.
3. In terms of my moral rights/personal rights in the Contents, I hereby declare that (a) I have no objection to the publication, use, modification, deletion and exploitation of the Contents by Licensees; (b) I forever waive and agree not to claim or assert any entitlement to any and all moral rights/personal rights in the Contents; and (c) I forever release Licensees and their sub-licensees from any claims for any such moral rights/personal rights.
4. Upon request of the Licensees, I will provide Licensees with the documents proving the ownership/rights of the Contents. In case of any intellectual property or other dispute or related lawsuit arising from the Contents submitted by me, I will bear all responsibilities and all financial compensations arising therefrom.
5. No matter for what reason I lost or may possibly lose the rights of the Contents, I will immediately notify the Licensees in writing and take effective measures to exempt the Licensees from any form of complaints, infringement claims, disputes, lawsuits, claims, etc. If it causes any losses to the Licensee, I will be responsible for compensating all losses and expenses of the Licensees, including but not limited to litigation expenses, attorney fees, investigation expenses, settlement amount or compensation amount stipulated in effective legal documents, etc.
6. I understand that, the Contents submitted by me will be considered non-confidential and the Licensees are under no obligation to keep such Contents confidential except pursuant to the Privacy Policy of CGTN The Media Challengers.
7. The content of this Declaration and any materials or information provided by the Licensees to me shall be deemed as confidential information of the Licensee, and I shall strictly keep it confidential. I will not use or disclose any part of such information to any third party without the prior written consent of Licensees. My obligation of confidentiality shall not be terminated with the termination of this Declaration.
8. Any dispute arising from or in connection with this Declaration shall be settled through friendly negotiation. If the negotiation fails, a lawsuit shall be brought to the people's court that has jurisdiction in the place where the Licensees are located. The applicable law shall be the law of the People's Republic of China (for the purpose of this Declaration, the laws of the People's Republic of China do not include the laws of the Hong Kong Special Administrative Region, the Macao Special Administrative Region and Taiwan, China).
CGTN THE MEDIA CHALLENGERS PRIVACY POLICY

Welcome to participate in the "THE MEDIA CHALLENGERS OF CGTN" (the "Program")!

China Global Television Network, with its address at No. A-1, Guanghua Rd, Chaoyang District, Beijing, PR China (“CGTN”, “we”, “our”, or “us”) is the controller of your personal data. CGTN is committed to protecting and respecting your privacy. To that end, we have issued this Privacy Policy (this “Policy”) to advise you sufficiently as to how we will collect, use, disclose, transfer and retain your personal data. Please read this Policy carefully before you participate in the Program and submit your personal data.If you disagree to this Policy, please cease your participation immediately and do not submit any personal data to us.

For the purpose of this Policy, "personal data" refers to any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. any information relating to an identified or identifiable natural person (‘data subject’);

For the purpose of this Policy, a "third party" refers to a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

For the purpose of this Policy, the "video" includes both the on-camera self-introduction and presentation video you submitted to us, and the original online video works you may voluntarily provide.

I How we collect and use your personal data

We will use your personal data that you may have provided directly to us solely for the purpose of carrying out the Program. We will not use any other means to obtain your personal data.

1. The personal data we may collect
To help us select eligible candidates for the Program, Participants who intend to register for the Program are requested to provide us with some personal data, including:

a) The personal data required for registering for the Program

When you register for the selection for the Program, you are requested to provide us with the following personal data or relevant information that may contain your personal data, including:

- Your name;
- Country/region;
- E-mail address;
- Employment status (employed/freelance/unemployed);
- Role (reporter or correspondent/anchor or host/editor/videographer/ influencer/podcaster/others); and
- A video URL containing your self-introduction and personal presentation

After receiving the above information submitted by you, we will assign you a unique Talent ID, and you are required to further provide the video file, a short description of your submitted video, and your resume.

The above data is necessary for you to register for the Program. If you refuse or fail to provide it, we will not have sufficient information to determine whether you are a qualified candidate, which will result in your ineligibility to participate in the Program.

b) The personal data you may choose to provide us

To enrich your profile as a candidate and give us a quick and complete picture of you and your story, you may voluntarily provide some personal data, including your highest level of educational attainment (school and qualification), current employer and mobile phone number.

If you would like to participate in our Excellent Web Original Video Works Selection Program, you may submit your original video works at your option.

Your failure to provide us with the personal data mentioned in this subsection for any consideration will not affect your participation as a candidate in the Program.

Please consider the privacy of others while recording your video. If the video you provide contains other individuals’ personal data, you should ensure that you have obtained the consent of others for the disclosure of other people's personal data. If you become aware that you have provided any personal data relating to any other individual without his/her consent, please contact us immediately for deletion of such data.

In addition, when submitting your personal data for the Program, the website (cgtn.com) publishing the Program may also collect some of your data, including using cookies technology to collect data. For information about how the website processes your personal data, please refer to the privacy policy of cgtn.com: https://www.cgtn.com/privacy.

2. How we use your personal data

CGTN will use the above personal data you provided for the purpose of selecting candidates for the Program. Specifically:

a) We will use your submitted personal data, i.e. your name, country/region, employment status, roles and video containing your self-introduction and personal presentation, as well as your personal data submitted at your option, i.e. your highest education level, current employer and mobile phone number, to determine whether you are a qualified candidate for the Program.

b) We will use your email address and your mobile phone number to send a confirmation email to you after you submit the registration form, or contact you for the purpose of the Program to communicate about all the matters necessary to complete the registration;

c) We will use the original video works you submitted to determine whether your video meets the requirements of the Excellent Web Original Video Works Selection Program; and

d) We may also use the data you submitted for necessary media promotion activities.

II How we retain your personal data

CGTN will use the server deployed in Singapore to retain your submitted personal data. Meanwhile, your personal data will be transferred to and processed by our operation team in Mainland China for the purposes disclosed in this Policy. We will only retain your personal data for such a minimum period as is necessary to achieve the purpose of data collection.

We will delete or anonymize your personal data immediately after the Program unless otherwise required by applicable laws and regulations. We will delete and anonymize your personal data once the Program ends, unless we otherwise obtain your consent.

III How we protect your personal data

To secure and protect your data, CGTN will endeavor to adopt a variety of physical, electronic, and management security measures that meet the industry standards and establish an access control mechanism to ensure that only authorized personnel may access your personal data. We will protect your personal data from unauthorized access, public disclosure, use, modification, damage or loss by, among other things, signing a confidentiality agreement with those who have access to your data. Please note, however, that while we take reasonable steps to protect your information, no website, internet transfer, computer system or wireless connection is absolutely secure.

Once a personal data security incident occurs, we will, in accordance with the applicable laws and regulations, promptly notify you of the basic information and possible impact of the incident, the actions we have taken or will take, suggestions for you to prevent and mitigate risks, remedial measures for you, etc. We will send you the notice by mail, letter, telephone, push notification, or otherwise. When it is difficult to inform data subjects on an individual basis, we will make an announcement in a reasonable and effective way. In addition, we will also take the initiative to report the handling of the personal data security incident in accordance with the requirements of regulatory authorities.

IV How we share, transfer and publicly disclose your personal data

1. Sharing

For the purposes disclosed in this Policy, we will engage third-party e-mail services to facilitate our internal transfer of data. CGTN will not share your personal data with any third party for purposes unrelated to the Program without your express consent.

Please note, however, that we may share your personal data necessary to fulfill our legal obligations, to protect your material interests or those of others, and to carry out duties that are in the public interest or to carry out duties that have been delegated to us. For example, in order to resolve urgent tort or economic disputes, or in connection with criminal or administrative investigations, we may provide your personal data to competent authorities upon request.

2. Transfer

CGTN will not transfer your personal data to any third party unless otherwise expressly agreed with you or upon your request.

3. Public disclosure

CGTN will not disclose your personal data publicly without your express consent.

Please note that for the purpose of organizing the Program, CGTN may place your uploaded or submitted video on public channels such as TV or the internet. If your video contains your personal data, your registration and/or participation in the Program will be deemed as your consent to our public disclosure of such personal data.

V How your personal data is transferred globally

During the process of your registration and participation in the selection for this Program, your personal data may, subject to your consent, be stored in our servers located in Singapore, and will be transferred to and processed by our operation team in Mainland China for the purposes disclosed in this Policy. Please refer to the information listed in the section “How we collect and use your personal data” above for the categories of data that may be transferred across borders. We will take appropriate measures to ensure data security in accordance with the applicable laws and regulations.

If personal data collected or generated within the European Economic Area (“EEA”) is transferred outside the EEA, we will comply with the provisions on international personal data transfer in the General Data Protection Regulation (“GDPR”). After informing you of the cross-border data transfer and the potential risks, we will seek your express consent and take appropriate technical and management measures to protect the security of your personal data. VI Your rights to your personal data

CGTN fully respects your rights to your personal data. The following are your rights under law and how we will respond to those rights. Please note that, for security reasons, we may request that you provide the necessary personal data to verify your identity before processing your request.

1. Right to be informed: We publish this Policy to inform you of how we may process your personal data. We are committed to improving the transparency of the use of your personal data.

2. Right of access: If you intend to exercise your right of access to your data, you may send an email to mediachallengers@cgtn.com to obtain your personal data held by us that you intend to access.

3. Right to rectification: In the event that you find any error in your personal data we have processed, you have the right to request us to correct it. You may request us to correct your information by sending an email to mediachallengers@cgtn.com. After confirmation of your request, we will make the correction.

4. Right to erasure: If you determine that we do not have a legitimate reason to continue to hold and process your information, you may request us to erase your personal data by sending an email to mediachallengers@cgtn.com.

5. Right to restriction of processing: You have the right to request restriction of our processing of your personal data. This means that we may retain such data without further processing. We will only retain the data necessary to respond to your request in the future. You may exercise your right to restriction of processing by sending an email to mediachallengers@cgtn.com.

6. Right to object: You have the right to object to our processing of your personal data even if such processing is based on our legitimate interest, or for the exercise of public power or direct marketing (including data aggregation), or for statistical reasons. You may exercise your right to object by sending an email to mediachallengers@cgtn.com.

7. Right to withdraw consent: If you agree to our processing of your personal data but change your mind later, you may withdraw your consent at any time. For example, if you give up the selection for this Program after submitting your information, you may withdraw your consent to our processing of your personal data by sending an email to mediachallengers@cgtn.com. We will immediately cease processing your personal data and erase your personal data in a timely manner.

8. Right to lodge a complaint: You have the right to lodge a complaint with the data protection authority in your country about our processing of your personal data.

In addition, CGTN promises not to use any of your personal data for automated decision-making.

We will respond to your request for the above data subject rights as soon as possible, and generally, within 30 days of the date of receipt of your request (which may be extended to 60 days if necessary and permitted by law, and if an extension is necessary, we will, within the aforesaid 30-day period, notify you of the reason for the extension, such as the complexity of your request or the vast amount of data). If you are dissatisfied with our response, you may refer your complaint to the competent regulatory authority in your jurisdiction.

VII How we process children’s personal data

Please note that the Program is only open to adults over 18 years of age. If you are under 18, please do not register for the Program or provide us with any personal data. If we are aware that we have collected personal data of minors under 18, we will delete the information. If you have mistakenly sent personal data of minors under 18, please contact us at mediachallengers@cgtn.com and we will erase such data immediately.

VIII How this Policy is updated

This policy may be updated or amended from time to time depending on the actual progress of the Program. We will send you notification of such changes through various channels. In general, we will post an announcement on the official website of the Program. If there are any material changes to the key terms of this Policy, we will also notify you via the email address in your account before such changes take effect. Such material changes include changes to the way we collect, process and retain your personal data and terms that may affect your right to be informed and substantive rights. Please be assured, however, that we will not diminish your rights under this Policy without your express consent.

We will sign a written agreement with this third party, requiring them to use personal data in strict accordance with the purpose disclosed in this Policy and take confidentiality and security measures to process personal data.

VII How we process children’s personal data

Please note that the Program is only open to adults over 18 years of age. If you are under 18, please do not register for the Program or provide us with any personal data. If we are aware that we have collected personal data of minors under 18, we will delete the information.
