China has significantly advanced protection of privacy rights: expert

Privacy is a fundamental human right and central to the protection of human dignity, and China has significantly advanced the protection of rights to privacy, a human rights expert said on Wednesday while addressing the 55th session of the Human Rights Council in Geneva.

"A milestone is the Personal Information Protection Law enacted in 2021, which enhances the right to privacy by providing a comprehensive legal framework for the protection of personal information," said Gong Xianghe, Executive Dean of Human Rights Institute of Southeast University in the eastern Chinese city of Nanjing. 

He made the remarks "on behalf of the China Society for Human Rights Studies on China's efforts to protect right to privacy."

This law follows the Cybersecurity Law of 2017, which also secures the right to privacy by establishing strict rules for personal data protection. Additionally, the Civil Code has dedicated a standalone chapter with eight articles to the right to privacy, said the professor, adding that the Criminal Law has provisions that protect citizens from privacy violations.

"Despite that the right to privacy is a recent development, China has so far developed a consistent number of regulations. These legislative efforts reflect both domestic needs and international influences, as China engages with global data protection standards," the professor noted.
